Legal
These Terms govern your use of Triplo AI. They are a binding contract. Section 5 and Section 6 are the ones that limit what you can hold us responsible for, and they matter most if you use Agents.

In short
This summary is for orientation only. The numbered sections below are the agreement.
These Terms of Service (the Terms) are an agreement between you and Elbruz Teknoloji Limited Şirketi, trading as Elbruz Technologies (Elbruz, we, us), the company that publishes Triplo AI. Triplo AI means the Triplo AI desktop and mobile applications, the Pi and Hermes agent capabilities, the hosted endpoints we operate for allowance models, media processing, document enrichment and licensing, the websites at triplo.ai and its subdomains, and the documentation (together, the Service).
You accept these Terms by installing, accessing or using the Service, by accepting them in the application, or by paying for a subscription. If you do not accept them, do not install or use the Service.
If you accept these Terms on behalf of a company or other organisation, you confirm that you have authority to bind it, and you in these Terms means that organisation as well as you personally.
You must be old enough to enter into a binding contract where you live, and at least 16 years old. The Service is not intended for children.
Triplo AI is a client. It places a prompt bar, a knowledge base and, in version 7.0, agents behind a global hotkey on your own machine. Your prompts, instructions, automations, conversations and knowledge bases are plain files on your disk, not rows in a database we hold.
We are not the model.
Triplo AI does not generate output. It assembles a prompt and sends it to the endpoint you selected — a provider you connected with your own key, a local model on your machine, or an allowance model we route on your behalf. The model that answers is operated by whoever operates it. Their terms, their availability, their pricing and their handling of your prompt are between you and them.
We may change, add to, or withdraw features of the Service. We will not remove a primary function of a paid product without notice to you. Some features depend on third parties, and those can change or disappear without us being able to prevent it.
Subject to these Terms and to payment of any applicable fees, we grant you a non-exclusive, non-transferable, revocable right to install and use the Service on the number of devices your plan allows, for your own purposes or your organisation's internal purposes.
You may not:
You are responsible for everything done through your licence, including by anyone you allow to use it.
Your content stays yours. Prompts, instructions, automations, conversations, knowledge bases, source files and anything an Agent reads or writes on your machine (Your Content) belong to you or to whoever you got them from. We claim no ownership in them.
We only process Your Content to the extent needed to run a feature you invoked. Which features send what, and where, is set out in full in the Privacy Policy and in the documentation. Neither we nor anybody acting for us trains models on Your Content.
You are responsible for having the right to use Your Content the way you use it, including any rights needed to send it to a model provider or to let an Agent act on it. Do not put material in the Service that you are not allowed to send outside your organisation.
Output. As between you and us, you own the output a model returns to you, to the extent it is capable of being owned. We make no claim to it. Note two things that are outside our control: identical or similar output may be generated for other people, and the law on whether AI output attracts copyright at all differs from country to country and is unsettled. The provider whose model produced the output may also apply its own terms to it.
Read this section before you rely on anything the Service produces.
Artificial intelligence is probabilistic, not deterministic. The same prompt can produce different answers. Output can be factually wrong, internally inconsistent, out of date, biased, incomplete, or entirely invented while reading as confident and authoritative. This is a property of the technology, not a defect we can engineer away, and it applies to every model reachable through the Service — hosted, allowance, bring-your-own-key and local alike.
You accept that the Service can produce unexpected, inaccurate or harmful results, and that you use its output at your own risk. Before you act on anything the Service produces, send it to anyone, publish it, put it into a system of record, or let it influence a decision, you are responsible for reviewing it and verifying it against a source you trust.
Output is not professional advice. Nothing the Service produces is legal, medical, financial, tax, accounting, engineering, safety or other regulated professional advice, and it is not a substitute for a qualified professional. If a decision matters, get a professional to look at it.
You further acknowledge that:
We do not review, approve or endorse model output. We do not warrant that it is accurate, complete, current, fit for any purpose, non-infringing or free of harmful content. By using output in any way, you assume full responsibility for that use and release us from liability for it, to the maximum extent permitted by law.
An Agent does not answer. It acts.
A model reads text and returns text. An Agent has tools. It opens a terminal, runs commands, reads files, creates files, changes files and deletes them, installs software, calls networks and APIs, and continues acting on its own between your instructions. It operates on a real machine holding real data. Actions it takes can be immediate, irreversible, and destructive.
The Service offers two Agents. Pi ships inside Triplo AI and acts on this machine, inside a folder you choose and approve. Hermes is a separate gateway that Triplo AI detects and connects to; it acts wherever that gateway runs, with whatever tools and permissions it was configured with, and Triplo AI can neither inspect nor narrow them. If the gateway runs on another machine, that machine is the one at risk.
6.1 You accept the risk before you get access. The first time you select Pi Agent or Hermes Agent, the application presents an explicit warning describing what that Agent can do on your machine, and nothing is selected until you accept it. Choosing to continue past that warning is your acceptance of this Section 6 and your informed consent to run an autonomous system against your own environment. The acknowledgement is recorded per agent, per installation. Declining it leaves the Agent unavailable, which is a supported way to use the product. If you do not accept the risks described here, do not enable Agents.
The acknowledgement is not a sandbox.
Accepting the warning grants no protection. Pi's folder approval and its stops at destructive operations are safety measures, not guarantees: they can be bypassed by an instruction you give, defeated by a command whose effect the Agent did not predict, or rendered irrelevant by a tool acting outside the folder. Hermes has no such boundary at all from Triplo AI's side. Treat everything reachable from the machine an Agent runs on as within its blast radius.
6.2 You are in control, and you are responsible. You choose whether to run an Agent, on which machine, against which folder, with which model, with which credentials and tools available to it, and with what instruction. Every action an Agent takes follows from a task you gave it. You accept responsibility, in full, for everything an Agent does while acting for you — including actions you did not anticipate, did not intend, did not observe, and would not have approved had you been asked.
Specifically, and without limiting the above, you accept the risk of:
Back up first. Every time.
Before you point an Agent at anything you care about, take a backup you have restored from before, or work on a copy, a disposable machine, or a branch you can throw away. Use credentials scoped as narrowly as the task allows, never production credentials where a test account will do, and never a machine holding data you cannot afford to lose. An Agent working inside version control with a clean tree is recoverable. An Agent working on the only copy of something is not.
6.3 We are not liable for what an Agent does. To the maximum extent permitted by applicable law, we are not responsible or liable for any loss, damage, cost or expense of any kind arising out of or connected to the use of an Agent — including loss of or damage to data, files, code, repositories, systems, infrastructure or accounts; loss of profit, revenue, business, contracts, goodwill or anticipated savings; unauthorised disclosure of confidential information or personal data; charges incurred with model providers or other third parties; downtime and the cost of remediation, restoration or re-creation; and any other direct, indirect, incidental, special, consequential, exemplary or punitive loss, whether or not we were told such loss was possible. Agents are provided as is and as available, with no warranty of any kind.
6.4 Hermes and third-party agents. Hermes runs outside Triplo AI. We do not build, host, configure, audit or control a Hermes gateway, the tools available to it, or the machine it runs on, and we do not control any other external agent or MCP server you connect. Triplo AI sends your prompt to the gateway you pointed it at and displays what comes back. Whatever happens on the far side is between you and whoever operates it. The same applies to any Model Context Protocol server, tool, script or automation you connect to the Service.
6.5 Supervision. Agents are a power tool for people who understand what they are pointing it at. Do not leave one running unattended against systems you cannot afford to lose, do not give one broader access than the task needs, and do not use one in any context that Section 3 puts off limits.
The Service connects to providers and services we do not operate: hosted model APIs you configure with your own key, local runtimes such as Ollama and LM Studio, MCP servers, websites the Service fetches at your request, and any endpoint you point an automation at. Your use of each of those is governed by that party's own terms and privacy policy, and any fees they charge are yours to pay.
We do not control and are not responsible for a third party's availability, performance, security, pricing, output, data handling, or any change to or withdrawal of its service. A failure, outage, rate limit, price change, content policy or degradation at a third party is not a defect in the Service, and does not entitle you to a refund.
Keep your API keys safe. Keys and tokens you configure are stored in your own configuration file on your own machine, protected by your operating system's file permissions and nothing else. They are included in backups and in Copy Debug Data. Anyone who can read your home directory can read them.
The Service includes open-source components, licensed under their own terms. Nothing here overrides a right you have under one of those licences.
Paid plans are billed in advance for the period you selected, through the payment processor or marketplace shown at checkout. Prices exclude VAT, sales tax and other indirect taxes, which are added where they apply. A failed or reversed payment may result in the licence being suspended or cancelled, and in the loss of any promotional or grandfathered pricing attached to it.
Some plans include an allowance: a quantity of usage on models we route on your behalf. The allowance is a convenience, not a guarantee of capacity. Which models it covers, and how much it includes, can change. Allowance models are not available to Agents, which run on your own provider keys. Allowance usage is not transferable and does not carry over unless the plan says so.
Fees are non-refundable. All fees are payable in advance and are not refunded, in whole or in part, for a period already paid for — including where you stop using the Service, cancel mid-period, lose access through a breach of these Terms, or find that a third-party model or service you relied on has changed. Cancelling stops the next renewal; it does not refund the current one. The only exceptions are the pro-rata refunds we owe you under Section 12 (a warranty we could not fix) and Section 17 (a change to these Terms you did not accept).
This is why trials exist. Evaluate the Service on a free trial, against your own work and your own models, before you pay for it.
Where you bought through a reseller, marketplace or channel partner, your price, billing and refund terms are the ones you agreed with them; these Terms still govern your use of the Service.
Nothing in this section limits any statutory right of withdrawal or refund you have as a consumer where you live.
Free trials, beta features, previews and any other free-of-charge use are provided as is and as available, with no warranty, no support commitment and no indemnity. We may change or end them at any time. Features in a trial or beta may never reach general release, may behave differently when they do, and may lose data you entered while using them. Evaluate before you buy.
The Service, its software, interface, documentation, brand, name and logo are ours or our licensors', and stay ours. These Terms grant you a licence to use the Service, and nothing more. All rights not expressly granted are reserved.
If you send us an idea, suggestion, bug report or feature request, we may use it without restriction, without obligation and without payment. Anything we build from it is ours. Do not send us anything you consider confidential.
We may name you as a customer and use your name and logo for that purpose only, in a way no more prominent than other customers', and will stop if you ask us in writing.
How we handle personal data is set out in the Privacy Policy, which forms part of these Terms. Where we process personal data on your behalf as a processor, our data processing addendum applies. [VERIFY: confirm the current DPA URL — the 2023 Terms pointed at triplo.ai/triplo.ai-Data-Processing-Addendum.pdf.]
Where you put other people's personal data into the Service, you are responsible for having a lawful basis to do so and for telling those people what you are doing. Do not put health data, payment card data, government identifiers or other specially protected data into the Service unless we have agreed to it in writing and the arrangement supports it.
We warrant that, during a paid subscription, the Service will perform substantially as the documentation describes, and that we use industry-standard measures against malicious code. If it does not, tell us within thirty days of the problem arising; we will use reasonable efforts to correct it, and if we cannot correct it within thirty days of your notice you may terminate and receive a pro-rata refund of the unused prepaid fees. That is your exclusive remedy for a breach of this warranty.
This warranty does not apply where the problem arises from misuse, from use contrary to the documentation, from modification not made by us, from a third-party model, service, gateway, tool or runtime, from anything an Agent did, or from free, trial or beta use.
Except for that warranty, and to the maximum extent permitted by law, the Service is provided as is and as available, with all faults, and we disclaim all other warranties, conditions and terms, express or implied, including merchantability, satisfactory quality, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure against every attack, or that any defect will be corrected, and we do not warrant the accuracy, reliability or suitability of anything a model or an Agent produces or does.
This section limits what you can recover from us.
It applies to every claim arising out of or connected to the Service or these Terms, whatever the legal theory — contract, tort, negligence, statute, strict liability or anything else — and it survives termination.
13.1 No indirect or consequential loss. To the maximum extent permitted by law, we are not liable for loss of profits, revenue, business, contracts, goodwill, anticipated savings, opportunity or reputation, for loss of, damage to or corruption of data, files, code or systems, for the cost of restoring or re-creating any of it, for business interruption, or for any indirect, special, incidental, consequential, exemplary or punitive damages, whether or not we were advised such loss was possible.
13.2 Cap. To the maximum extent permitted by law, our total aggregate liability for all claims arising in any twelve-month period is limited to the amount you actually paid us for the Service in the twelve months before the event giving rise to the first claim, or fifty United States dollars if you paid us nothing.
13.3 AI output and Agents. For the avoidance of any doubt, the exclusions in Section 5 and Section 6 apply in full. We are not liable for any loss arising from model output you relied on, or from anything an Agent did, failed to do, or did differently from what you expected, including data loss and financial loss.
13.4 Third parties. We are not liable for the acts, omissions, outages, pricing, security or data handling of any model provider, gateway, MCP server, tool, marketplace, payment processor or other third party, or for any resulting disruption to the Service.
13.5 What is never excluded. Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for anything else that cannot be excluded or limited under the law that applies to you. If you are a consumer, your mandatory statutory rights stand regardless of anything written here, and these limits apply only to the extent that law allows.
13.6 Allocation of risk. The pricing of the Service reflects this allocation of risk. Without these limits, we could not offer the Service on these terms.
You will defend, indemnify and hold harmless Elbruz, its affiliates and their officers, directors and employees against any third-party claim, and any loss, liability, damage, cost or expense (including reasonable legal fees) arising from: your use of the Service in breach of these Terms or of applicable law; Your Content, including any claim that it infringes a third party's rights; anything an Agent you ran did to a third party's systems, data or rights; and your use of, or reliance on, output produced through the Service.
We will tell you promptly about any such claim, give you control of the defence, and cooperate at your expense. You may not settle a claim in a way that admits fault on our part or imposes an obligation on us without our written consent.
These Terms apply from your first use of the Service and continue while you use it or hold a subscription. You may stop at any time by ceasing use and uninstalling; cancelling a subscription stops future renewals and takes effect at the end of the period already paid for.
We may suspend or terminate your access if you materially breach these Terms and do not fix it within thirty days of written notice, immediately where the breach cannot be fixed or where continued access would break the law or endanger the Service or other users, if payment is more than sixty days overdue, or if we reasonably suspect fraud, licence abuse or activity that materially harms our systems. Where we can, we give notice first, and we restore access once the cause is resolved.
On termination your right to use the Service ends and any outstanding fees become due. Your content stays on your own disk — we do not hold it and cannot delete it for you. Anything we do hold that relates to your account is handled as the Privacy Policy describes. Sections 4, 5, 6, 10, 12, 13, 14, 16 and 18 survive termination.
The Service is subject to export control and sanctions laws, including those of Türkiye, the European Union and the United States. You confirm that you are not located in, and are not a national or resident of, a country subject to comprehensive sanctions, that you are not a person or entity on a restricted-party or sanctions list and are not owned or controlled by or acting for one, and that you will not export, re-export or give access to the Service in breach of those laws.
We may update these Terms. If a change is material, we will tell you before it takes effect — by email to the address on your account, by a notice in the application, or on this page — and will give you at least thirty days' notice unless the change is required by law or by a security or regulatory need, in which case it takes effect as soon as it must.
Continuing to use the Service after a change takes effect means you accept it. If you do not, stop using the Service and tell us at contract-notices@triplo.ai; if you have a paid subscription that has not yet run out, you may terminate and receive a pro-rata refund of the unused prepaid fees. The version on this page is always the one in force, and the date at the top says when it changed.
Governing law and forum. These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict of law rules, and the courts of İstanbul, Türkiye have exclusive jurisdiction over any dispute arising out of or connected to them. If you are a consumer, this does not deprive you of the protection of the mandatory law of the country where you live, and you may also be able to bring proceedings in your local courts.
Notices. Legal notices to us go to contract-notices@triplo.ai, or to Elbruz Teknoloji Limited Şirketi at the registered address below. Notices to you go to the email address on your account or to a notice shown in the application. Support requests are not legal notices; send those to support@triplo.ai.
Force majeure. Neither of us is liable for delay or failure to perform caused by something beyond reasonable control — natural disaster, war, civil unrest, epidemic, government action, strike, network or power failure, or the failure of an upstream provider. Payment obligations are not excused.
Assignment. You may not assign these Terms without our written consent. We may assign them to an affiliate or to a successor in a merger, acquisition or sale of assets, on notice to you.
Severability and waiver. If a provision is held unenforceable, it is limited or removed to the minimum extent necessary and the rest stays in force. Not enforcing a right on one occasion does not waive it.
Independent parties. Nothing here creates a partnership, joint venture, employment or agency relationship, and neither of us may bind the other.
Entire agreement. These Terms, the Privacy Policy, and any order or plan terms you accepted are the whole agreement between us about the Service, and replace anything said or written before. Terms in a purchase order you issue have no effect.
Language. These Terms are written in English. A translation is provided for convenience only; where they differ, the English version governs, except where mandatory local law says otherwise.
